Rules of the "Grand Opening of the Pop Up Studio by JOY in me" competition

    1. GENERAL CONDITIONS

    1. The organizer and sponsor of the online competition called " Opening of Pop Up Studio JOY in me " (hereinafter referred to as the "Competition") is Joy in me SC, ul. Ogrodowa 48/54, 00-876 Warsaw - hereinafter referred to as the "Organizer".

    2. The conditions of participation in the Competition are specified exclusively in these Competition Rules and in mandatory legal provisions.

    3. The competition is organized in the territory of the Republic of Poland.

    4. Participation in the Competition constitutes acceptance of the Competition rules contained in these Regulations. Participants agree to abide by the rules set forth therein.

    5. The Organizer is the promiser of the prize within the meaning of Articles 919 and 921 of the Civil Code.

    6. The Organizer conducts the Competition using the Instagram page @joyinme_yoga @popupstudio_joyinme

    7. During the Competition, the Competition Rules will be available on the Organizer's website at the following address:

    1. DURATION OF THE COMPETITION

    1. The Contest runs from 4 May 2022, 10:00:00 AM to 8 May 2022, 11:59:00 PM (“Contest Period”).

    III. COMPETITION PARTICIPANTS

    1. The Competition is open to natural persons (hereinafter referred to as "Participants") who:

    1.1 are over 13 years of age, with the proviso that persons without full legal capacity (i.e. minors or partially incapacitated persons) must obtain prior consent from their legal guardian to participate in the Competition and to the processing of their personal data in accordance with the provisions of the Regulations;

    1.2 have their place of residence in the territory of the Republic of Poland;

    1.3 are consumers within the meaning of Article 22 1 of the Civil Code.

    1. Participants in the Competition are not eligible to participate in the Competition if they are employed by the Organizer or any of its subsidiaries, affiliates, or related companies, agencies collaborating with the Organizer, members of the Competition jury, or their families. Family includes ascendants, descendants, spouses, siblings, and siblings of spouses, as well as individuals in a relationship with them, through adoption, or who share a household.

    2. The Participant takes part in the Competition independently, on his or her own behalf.

    3. Participation in the Competition is voluntary.

    4. The Organizer reserves the right to exclude Participants from the Competition and, in extreme cases, to block the participation in the Competition of those Participants who violate the provisions of these Regulations, in particular:

    5.1. undertake actions that are contrary to the law, good practice or that harm the legitimate interests of third parties;

    5.2. undertake actions aimed at circumventing or indicating an attempt to circumvent the Regulations or the mechanisms and principles of operation of the Competition;

    5.3. undertake actions that violate the legitimate interests of the Organizer or damage its image.



    1. COMPETITION TASK

    2. To participate in the competition, the participant must have access to the Internet and post a comment under the competition post answering the question along with a short justification: Tell us what your favorite JOYa product is and why.

    1. AWARDS

    1. The main prizes in the Competition are 10 invitations to the Opening of JOY in me POP UP STUDIO on May 14, 2022

    2. The Competition Jury, composed of representatives of the Organizer, will select five winning entries. Creativity, ingenuity, originality, and compliance with all formal requirements will be considered in the evaluation.

    3. The Contest Winner will be notified by the Organizer of their prize between May 9, 2022, 10:00:00 AM and May 10, 2022, 11:59:00 PM via private message on Instagram, along with details on how to claim their prize. Contest results will also be made publicly available via Instagram Stories.

    4. A necessary condition for confirming participation in the Competition and receiving the Prize is that the Organizer receives a response from the Participant within 72 hours of receiving the Organizer's notification of the prize. Winners without full legal capacity must also include in their message a statement from their legal guardian, consenting to their ward's participation in the Competition.

    5. If a Participant fails to respond to the Organizer's message within the time specified above, they forfeit their right to receive the Prize, and the Prize remains the property of the Organizer. Before issuing the Prize, the Organizer or a person designated by them has the right to verify the Participant's age or the validity of the consent granted by the Participant's legal guardian who does not have full legal capacity, in particular by requesting that a scan of the Participant's ID be sent by email within 5 business days, or in the case of a minor Participant, a handwritten scan of the Participant's guardian's statement consenting to participation in the Competition, along with a scan of proof of sending such statement, to the following address: contact@joyinme.co. If the Participant fails to fulfill the obligations specified in the preceding sentence, the Prize will not be awarded and will remain the property of the Organizer.

    6. The Organizer will send the Prize to the Winner within 14 business days of receiving the Winner's message with the shipping address.

    7. A Competition Participant who has received a prize is not entitled to request the exchange of the prize for cash or any other type of prize.

    8. Competition Participants do not have the right to reserve any special properties of the Prize.

    9. Competition participants may not transfer the right to receive the prize to third parties.

    10. A Participant may submit multiple entries to the Competition but may only win one Prize.

    11. The Organizer reserves the right to verify whether a Participant's conduct complies with these Rules. The Organizer has the right to refuse to issue a Prize to a Participant if any provision of these Rules is violated. If a violation of these Rules is discovered after the Prize has been delivered, the Organizer may request its return. In such a case, the Prize remains the property of the Organizer, and the Participant is obligated to cover any losses incurred by the Organizer as a result of their disqualification.

    12. The Organizer is not responsible for the inability to deliver the Prize due to the Participant's failure to collect it. In such a case, the Prize remains the property of the Organizer.

    13. The Organizer reserves the right to award the Prize, which remains its property, at its discretion, to other Participants selected in accordance with the provisions of the Regulations.

    1. COMPLAINT PROCEDURE

    1. Complaints regarding the course of the Competition may be submitted by e-mail to the Organizer's address, i.e. contact@joyinme.co with the note "Competition: May Day with JOY in me"

    2. The complaint should include: the name, surname and exact address of the Participant as well as a detailed description and indication of the reason for the complaint and the Participant’s request.

    3. Complaints will be reviewed by the Organizer immediately, but no later than 14 days from the date the complaint is received by the Organizer. The Participant will be notified of the Organizer's decision immediately at the address provided in the complaint, but no later than 5 days from the date the complaint is reviewed.

    VII. PERSONAL DATA PROCESSING

    1. Data obtained in connection with the Contest will be collected in accordance with the Organizer's Privacy Policy, available at: https://joyinme.co/policies/privacy-policy. By participating in the Contest, each Participant consents to the terms and conditions set forth in the Organizer's Privacy Policy.

    2. The Organizer is not responsible for any changes (or deactivation) of the provided e-mail address or Instagram and/or Facebook account by the Participant during the Competition and in the period necessary to select the winner and award the Prize.

    VIII. FINAL PROVISIONS

    1. In matters not regulated by these Regulations, the provisions of Polish law shall apply.

    2. Any disputes arising from the performance of obligations related to this Competition will be resolved by a competent common court.

    3. All costs associated with participation in the Competition, including internet access fees, are borne by the Competition Participant.

    4. The Organizer declares that the Competition is in no way sponsored, endorsed, managed or associated with the entities owning the Facebook website.

    5. The Organizer reserves the right to change these Regulations at any time, subject to respecting the acquired rights of Participants.

    6. The Regulations come into force on the date of commencement of the Competition.
